These Terms of Service govern your access to and use of MyElyra AI, including its website, interactive AI romance stories, creator tools, community features, credits, and subscriptions (collectively, the "Service"). The Service is operated by the MyElyra service provider ("we," "us," or "MyElyra").

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

• You must be at least 18 years old and legally able to enter into these Terms.
• You are responsible for the accuracy of your account information, safeguarding your sign-in credentials, and all activity under your account.
• Tell us promptly if you believe your account has been accessed without permission. You may not sell, transfer, or share an account in a way that compromises its security.

2. The Service and AI-generated content

MyElyra provides fictional AI character interactions and related storytelling features. AI output is generated automatically and may be inaccurate, incomplete, unexpected, or objectionable. It does not represent the views of MyElyra and is not medical, legal, financial, psychological, or other professional advice.

You are responsible for deciding whether and how to use AI output. Do not rely on it for emergencies, important decisions, or real-world professional guidance. Features, models, credit costs, and output quality may change as the Service evolves.

3. Your content and creator content

You retain the rights you hold in content you submit, including character profiles, images, prompts, messages, and comments. You confirm that you have the rights and permissions needed to submit that content.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, display, and distribute your content only as reasonably needed to operate, secure, moderate, and improve the Service. Public characters and comments may be displayed to other users. Private content is used only to provide the relevant private features, subject to our Privacy Policy.

Deleting or changing public content may affect future display, but limited copies may remain where necessary for existing chat history, backups, fraud prevention, dispute handling, or legal compliance.

4. Acceptable use

You must not use the Service to create, upload, distribute, request, or promote content or activity that:

• is illegal, fraudulent, threatening, exploitative, or intended to cause harm;
• sexualizes minors, depicts child sexual abuse, or otherwise endangers minors;
• harasses others or promotes hate, violence, discrimination, or non-consensual intimate content;
• infringes intellectual property, privacy, publicity, or other rights;
• contains malware, disrupts the Service, bypasses access controls, or attempts unauthorized access;
• uses bots, scraping, automated requests, or reverse engineering except where we have expressly allowed it; or
• manipulates promotions, rewards, credits, reviews, reports, or enforcement systems.

5. Moderation and safety

We may review reports and relevant content, restrict visibility, remove content, reverse improperly obtained rewards, or limit accounts when reasonably necessary to enforce these Terms, protect users, comply with law, or secure the Service. We do not guarantee that all content is reviewed before it appears.

Blocking and reporting tools are provided for safety and moderation. Do not misuse them to harass others or submit knowingly false reports.

6. Credits, purchases, and subscriptions

• Credits are digital units used for eligible features. They have no cash value, are not transferable, and cannot be exchanged outside the Service.
• Credit packages are one-time purchases and do not renew automatically. Package contents, bonuses, prices, and applicable taxes are shown before checkout.
• MyElyra+ is a monthly subscription that renews automatically until canceled. The price, included benefits, and billing interval are shown before checkout.
• Canceling a subscription stops future renewals and normally takes effect at the end of the current paid period. Access to cancellation and billing controls may be provided by our payment provider.
• Promotional, bonus, or complimentary credits may have additional conditions disclosed with the relevant offer. We may correct balances affected by error, fraud, refunds, or chargebacks.

7. Payments and refunds

Payments are processed by a third-party payment provider under its own terms and privacy notice. You authorize the applicable charges and must provide accurate billing information. Except where required by law or stated in a specific offer, completed purchases are final and non-refundable.

If a payment is refunded, reversed, disputed, or unpaid, we may withdraw the related credits or subscription benefits. Contact us before initiating a payment dispute so we can try to resolve the issue. Nothing in these Terms limits mandatory consumer rights.

8. Intellectual property

The Service, including its software, interface, branding, documentation, and other materials provided by us or our licensors, is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

9. Third-party services and availability

The Service relies on third-party authentication, cloud, AI, and payment services and may link to external websites. We do not control third-party services and are not responsible for their independent content or practices.

We may change, suspend, or discontinue features for maintenance, security, legal, commercial, or technical reasons. We do not guarantee uninterrupted, error-free, or permanently available operation.

10. Suspension and termination

You may stop using the Service at any time. We may restrict or terminate access, remove content, or refuse service if you violate these Terms, create risk or legal exposure, fail to pay amounts due, or threaten the Service or other users. Where practical and legally required, we will provide notice.

Termination does not remove obligations or rights that by their nature should survive, including payment obligations, content licenses needed for retained copies, disclaimers, limitations of liability, and dispute terms.

11. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy, suitability, safety, or availability of AI output or user content.

To the fullest extent permitted by law, MyElyra and its service providers will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Service. Liability that cannot legally be excluded remains unaffected.

12. Applicable law, disputes, and changes

These Terms are governed by applicable law, without limiting any mandatory protections available where you live. Please contact us first so we can try to resolve a dispute in good faith. Unresolved disputes may be submitted to a court with competent jurisdiction.

We may update these Terms as the Service or legal requirements change. We will post the current version here and provide reasonable notice of material changes when required. Continued use after the effective date means you accept the updated Terms.
